What is a Pendente Lite Motion?

Pendente lite motions are often “indispensable in a matrimonial action.” Rose v. Csapo, 359 N.J. Super 53, 58 (Ch. Div. 2002). Courts are authorized by statute to make an award of pendente lite support as the circumstances of the parties and the nature of the case shall render fit, reasonable and just. N.J.S.A. 2A:34-23. The general purpose of a pendente lite order is to maintain the status quo between the parties and prevent irreparable harm. Mallamo v. Mallamo,280 N.J. Super. 8, 11-12 (App. Div. 1995).
